The unprecedented nature of the COVID-19 public health crisis has many businesses and employers wondering whether anticipated financial losses are covered by insurance. Coverage issues are just now starting to emerge, and they are sure to play out in the coming weeks, months, and even years. In the midst of so much uncertainty, here is what you can do now:

  • Locate your policies and make sure they are available to those who need them in a work-from-home or quarantined environment. (Recognize it could be difficult to access paper files left behind in an office filing cabinet for several weeks.)
  • Keep track of your expenses/losses and potential damages incurred during the COVID-19 crisis.
  • Review your claim reporting requirements, including appropriate contact information (brokers, insurers, etc.) for submission of claims. Again, make sure this information is accessible remotely in the event of work-from-home and quarantine situations.
  • Review the coverages available to you, in particular “Event Cancellation” coverage, “Business Interruption” coverage, and “Commercial General Liability” coverage.
  • Consult with coverage counsel to assess your business’s specific situation and policy language.
