Health Care in the FY 2023 Omnibus

On Dec. 23, 2022, President Joe Biden signed into law the fiscal year (FY) 2023 omnibus appropriations bill. The legislation was passed by the Senate (68-29) on Dec. 22 and the House (225-201-1) on Dec. 23. The bill provides $1.7 billion in funding, $858 billion in military funding and $772 billion for domestic programs, in government funding through FY 2023. Additionally, the legislation includes a range of domestic and foreign policy priorities, including support for Ukraine, electoral reform, workplace accommodations for pregnant workers, and restrictions on the use of the social media app TikTok.

The omnibus has numerous health care provisions and policies that impact patients and companies. The omnibus package funds key health care agencies within the Department of Health and Human Services (HHS), including the National Institutes of Health (NIH), the Food and Drug Administration (FDA) and the Centers for Disease Control and Prevention (CDC). The omnibus also extends telehealth flexibilities, boosts mental health funding, extends the Medicare rural hospital programs and addresses physician reimbursement rates. Additionally, the legislation delays the Medicare PAYGO sequester for two years, through the end of 2024.
