ICE Raids in the Workplace: Employer Responsibilities and Employee Rights

When an ICE raid occurs, both employers and employees must understand their rights and responsibilities. In our recent webinar, employment law attorney Frank Custode discussed how businesses can prepare for these situations and ensure employees know how to respond appropriately.

First, employees should be trained on how to interact with ICE agents. They have the right to choose whether or not to speak with an agent and may request a lawyer before answering any questions. However, employers should not instruct employees to refuse cooperation outright.

It’s also important to communicate clear guidelines to employees. They should never hide, leave the premises, or attempt to evade ICE officers, and employers must not assist in such actions. Instead, employees should keep copies of their documentation readily available and ensure all records are up to date.

ICE raids can last for hours, and in some cases, certain employees may have medical or family-related concerns. Employers can advocate on their behalf by discussing these issues with ICE agents and requesting reasonable accommodations.
