The United States Environmental Protection Agency (“EPA”) Office of Inspector General (“OIG”) issued a March 28th notification that it is beginning preliminary research to evaluate the federal agency’s implementation and enforcement of the Lead-Based Paint Renovation, Repair and Painting Rule (“RRP”).
OIG states as its objective the determination of whether EPA has an effective strategy to implement and enforce the lead-based paint RRP.
The RRP requires that firms performing renovation, repair, and painting projects that disturb lead-based paint in homes, child care facilities, and pre-schools built before 1978 have their firm certified by EPA (or an EPA authorized state) and use certified renovators who are trained by EPA-approved training providers and follow lead-safe work practices.
The RRP was promulgated pursuant to the authority provided by the federal Residential Lead-Based Paint Hazard Reduction Act of 1992. This legislation amended the Toxic Substances Control Act by adding Title IV (Lead Exposure Reduction).
OIG states that it plans to conduct work at EPA headquarters and at any other appropriate sites.
