LAG Schleswig-Holstein: Kündigung wegen ausschweifender Internetnutzung trotz 21 Jahren im Betrieb ohne Abmahnung möglich

Einem Arbeitnehmer, der ohne Erlaubnis während der Arbeitszeit den vom Arbeitgeber zur Verfügung gestellten Computer exzessiv für privates ‘Surfen nutzt, kann auch ohne Abmahnung gekündigt werden. Dem stand in einer aktuellen Entscheidung des Landesarbeitsgerichts Schleswig-Holstein auch eine Betriebszugehörigkeit von 21 Jahren nicht entgegen (Urteil vom 6. Mai 2014, Az.: 1 Sa 421/13).

Bei der Suche nach der Ursache für zunehmende Verzögerungen im EDV-System des Betriebs stieß der Arbeitgeber darauf, dass vom PC des Klägers eine erhebliche Datenmenge heruntergeladen wurde. Auf der Festplatte befanden sich über 17.000 private Dateien. Nachvollzogen werden konnte etwa der Besuch von sozialen Netzwerken sowie der Abruf von Musik und Filmen über Filesharing-Plattformen. Die entsprechenden Dateien waren zwar gelöscht worden, die Downloads konnten aber dennoch vom Arbeitgeber eingesehen werden. Dieser sprach daraufhin die ordentliche Kündigung aus.

Im Rahmen seiner Kündigungsschutzklage hatte der Kläger bestritten, die Dateien heruntergeladen zu haben. Sowohl das Arbeitsgericht als auch das Landesarbeitsgericht wiesen die Kündigungsschutzklage ab. Nach der Entscheidung des LAG ist die ordentliche Kündigung wirksam, weil der Arbeitnehmer bei einer derart ausufernden Nutzung des Internets seine Arbeitspflicht in besonders gravierendem Maße verletzt. Nach der Beweisaufnahme stand für das Gericht fest, dass der Kläger die Dateien heruntergeladen hatte.

Der Arbeitnehmer darf den Dienstrechner grundsätzlich nur bei ausdrücklicher Erlaubnis oder nachweisbarer stillschweigender Duldung für private Zwecke nutzen. Von einer Duldung des Verhaltens durch den Arbeitgeber durfte der Kläger vorliegend aber bei einer so exzessiven Nutzung während der Arbeitszeit nicht ausgehen. Außerdem hat er durch das Aufsuchen von Filesharing-Plattformen zum Download von Musik auch konkret die Gefahr geschaffen, dass das betriebliche Datenverarbeitungssystem mit schädlicher Software infiziert wird.

Angesichts des Umfangs der privaten Internetnutzung war eine Abmahnung vor Ausspruch der Kündigung trotz der langen Betriebszugehörigkeit nicht erforderlich. Nach Ansicht des LAG müsse der Arbeitnehmer schlicht wissen, dass Derartiges während der Arbeitszeit nicht erlaubt ist.
