Stark, C.J.  Defendant’s objection to magistrate’s report is overruled and its motion to dismiss is denied.

Defendant objected to the magistrate’s Report and Recommendation that its motion to dismiss for lack of personal jurisdiction be denied.  The court follows the reasoning in the Acorda litigation, 2015 WL 186833(D.Del Jan. 14, 2015) and notes that the issue has been appealed to the Federal Circuit in that case.
