Massachusetts Cannabis Control Commission Vote on Host Community Agreement, Community Impact Fee and Social Equity Regulations Scheduled for September 8, 2023

On August 16, 2023, the Cannabis Control Commission posted its draft regulations for 935 C.M.R 501.000: Medical Use of Marijuana and 935 C.M.R 500.000: Adult Use of Marijuana in anticipation of a vote on final regulations at the Commission’s September 8, 2023, public hearing. In addition to providing detailed requirements for Host Community Agreements (HCA) and Community Impact Fee (CIF) invoicing, the proposed regulations eliminate the Social Consumption Pilot Program that restricted social consumption of cannabis to a limited number of communities, include provisions for verification of Social Equity Businesses, and provide best practices for HCA negotiations between municipalities and License Applicants that have been designated as Social Equity Program Participants or Economic Empowerment Priority Applicants. Pursuant to M.G.L. c. 30A, § 2, notices must be filed with the Office of the Secretary of the Commonwealth prior to the adoption, amendment, or repeal of any regulation as to which a public hearing is required.
