Neuerungen im Arbeitsrecht 2014

Mit den Koalitionsverhandlungen Ende des letzten Jahres rückten auch eine Vielzahl arbeitsrechtlicher Themen in den Fokus von Medien und Öffentlichkeit. Prominentestes Beispiel hierfür ist sicherlich die geplante Einführung eines branchenübergreifenden gesetzlichen Mindestlohns, aber auch für das Arbeitnehmerüberlassungsgesetz (AÜG) sieht der Koalitionsvertrag einige wichtige Änderungen vor. Noch bevor tatsächlich konkrete Neuerungen hinsichtlich dieser beiden Themen verabschiedet worden sind, gibt es aber zum 1. Januar 2014 einige andere interessante Änderungen.

Aus Unternehmersicht ist zunächst wichtig, dass auch 2014 (wie im vergangenen Jahr) die Bezugsdauer für das konjunkturelle Kurzarbeitergeld bis zu zwölf Monate betragen kann. Ohne die verlängernde Verordnung des zuständigen Bundesministeriums für Arbeit und Soziales hätte die maximal mögliche Bezugsdauer ab Januar 2014 nach der gesetzlichen Regelung lediglich sechs Monate betragen (§ 104 Abs. 1 S. 1 SGB III).

Ebenfalls mediales Echo hat die Tatsache gefunden, dass ab dem 1. Januar 2014 alle Arbeitnehmer aus Bulgarien und Rumänien volle Arbeitnehmerfeizügigkeit genießen, weil entsprechende Übergangsvorschriften weggefallen sind. Inwieweit dies Auswirkungen auf den deutschen Arbeitsmarkt haben wird, bleibt abzuwarten – jedenfalls benötigen bulgarische und rumänische Staatsangehörige nun keine Arbeitsgenehmigung-EU mehr. Eine solche benötigen aber weiterhin zum Beispiel Arbeitnehmer aus Kroatien (§ 284 SGB III).

Abschließend noch ein kurzer Hinweis: In einigen Branchen, in denen aktuell schon tariflichen Mindestlöhne gelten, kommt es zu Erhöhungen. Eine Übersicht lässt sich HIER auf den Webseiten der Bundesregierung einsehen.
