- Excerpt from LabMD Loses Another Round in Fight With FTC Over Data Security Authority:
On January 20, Georgia-based medical testing company LabMD lost another around in its ongoing dispute with the FTC arising out of data security breaches experienced by the company. The Eleventh Circuit Court of Appeals upheld a lower court’s May ruling that it lacked jurisdiction over the Commission’s case against the company until a parallel administrative proceeding was complete. This decision presents yet another setback for the company in its challenge to the FTC’s authority over information security matters.
