1. What’s New?
It was another busy week for consumer data privacy bills.
Representative Elkins’ Minnesota Consumer Data Privacy Act (HF 2309) continued to advance. On March 5, the bill cleared the House Judiciary Committee on a unanimous voice vote. Meanwhile, its Senate Companion, SF2915, cleared the Senate Commerce Committee, also on a unanimous voice vote. HF2309 will be heard in the House State Government Committee on March 12 for consideration of the bill’s fiscal note for the cost of Attorney General enforcement. SF 2915 was re-referred to the Senate Judiciary and Public Safety Committee.
In Maryland, an amended SB 541 passed out of the Senate Finance Committee on March 5. The bill was considered on the Senate floor on March 8 where it was laid over for further consideration of the committee amendments.
In Missouri, SB 1501 was read for a second time and referred to the Senate Commerce, Consumer Protection, Energy and the Environment Committee.
In Maine, another work session was scheduled for March 14 on the competing consumer data privacy bills (LD 1973 / LD 1977).
New Hampshire Governor Chris Sununu signed SB 255 into law on March 7, making New Hampshire the fourteenth state to enact a state consumer data privacy law. You can find our comparison charts of the various laws here.
The Virginia legislature closed on March 9. As we reported last week, prior to closing, the legislature passed companion VCDPA amendment bills (SB 361 / HB 707), which add additional provisions to the VCDPA relating to children under the age of 13.
Finally, the West Virginia legislature closed on March 9 without passing a consumer data privacy bill. Last week, we reported that the House had passed HB 5698 shortly after the bill was introduced. However, the bill could not make it through the Senate before the session closed.
In children’s data privacy bill developments, an amended Maryland SB 571 – an Age-Appropriate Design Code Act bill – passed out of the Senate Finance Committee on March 5. The bill was laid over on the Senate floor on March 8.
In consumer health data privacy bill news, the Hawaii House passed HB 1566 on March 5. The bill was referred to two Senate committees. In Mississippi, HB 1268 died in committee on March 5.
In data broker bill developments, a new data broker registration bill was introduced in Alabama (SB 213).
Finally, the Washington legislature closed on March 7.
