Reargument Motion Is Denied; Belated Contentions Are Stricken

Stark, C.J.  Plaintiff’s motion for reargument is denied.

A reasonable juror could only conclude that defendant had proven reasonable diligence.  The motion for reargument contains arguments previously heard and the court will not now rethink its decision.  Additionally, plaintiff’s objections to discovery decisions by a special master are overruled.  Defendant’s motion to strike plaintiff’s infringement contentions is granted as untimely.  Plaintiff’s motion to strike portions of defendant’s expert reports is granted only to the extent they respond to plaintiff’s stricken expert reports.  The court adopts the master’s order.
