The Arkansas Department of Energy & Environment – Division of Environmental Quality (“DEQ”) and Ozark Mountain Solid Waste District Board of Directors (“Ozark”) entered into a June 26th Consent Administrative Order (“CAO”) addressing an alleged violation of Arkansas Pollution Control & Ecology Commission Rule 11. See LIS No. 23-052.
The CAO provides that Ozark is a Regional Solid Waste Management District (“District”) in North Central Arkansas.
The District encompasses the following counties:
- Baxter
- Boone
- Marion
- Newton
- Searcy
DEQ is noted to administer and authorize distributions from the Solid Waste Management and Recycling Fund pursuant to APC&EC Rule 11.401.
Ozark is stated to have failed to provide a full and complete audit report for fiscal year 2020 to DEQ and the Arkansas Legislative Audit by March 31, 2021, violating APC&EC 11.407(G)(8). A similar violation is alleged for the following two years.
Ozark is stated to have notified DEQ on June 2nd that the accounting firm of John Langham & Co. will begin:
. . . audits for June 30, 2020 through June 30, 2022. . . and will have the audited financial. . . before September 30, 2023.
The CAO requires that on or before September 30th Ozark provide DEQ and the Arkansas Legislative Audit will provide full and complete audit reports for fiscal years 2020, 2021, and 2022.
