  • Texas AG Ken Paxton has sued technology giant Google over allegations that several of the company’s products—including Google Assistant, Google Photos, and Nest Hub Max—capture and utilize biometric information without users’ knowledge or consent in violation of the Texas Capture or Use of Biometric Identifier Act.
  • According to the complaint, Google has used a variety of technologies to capture biometrics, including voiceprints and facial geometry of anyone who comes into view (including non-users).
  • The complaint requests injunctive relief, including barring the use of biometric identifiers without consent, barring voice or facial recognition technology without similar informed consent, destruction of biometric identifiers within a reasonable time, and barring misrepresentations, including by omission, that Google does not collect biometric identifiers, among other things. The complaint also seeks civil monetary penalties, attorney fees and costs, and interest.
