The U.S. Department of Labor has supplemented its guidance on the Families First Coronavirus Response Act by posting on its website a model notice that employers must display in the workplace to inform employees of their rights under the Families First Act.
As explained in our previous advisories, the Families First Act requires employers to provide paid FMLA leave and paid sick leave to employees for certain reasons specified in the Act and attributable to the ongoing coronavirus outbreak. These paid leaves are to be subsidized through payroll tax credits.
The DOL also posted a set of Questions and Answers, which address a number of issues that employers have been debating over the past few days, including: how to calculate the 500-employee threshold, how small businesses with fewer than 50 employees can seek an exemption, and how to calculate pay due to employees.
