Very recently, various new personal data laws and substantial amendments to existing laws have been promulgated in the Greater China region. For example:
- 10 June 2021: New data security laws were promulgated in China and will enter into force on 01 September 2021.
- 29 April 2021: The second draft of the new Personal Information Protection Law was published in China and expected to be promulgated and in force soon.
- January 2020 / July 2021: Proposed amendments to the existing Personal Data (Privacy) Ordinance (Cap. 486) ("PDPO") proposed in legislature in Hong Kong.
These laws and amendments will significantly expand the scope of existing regulations and provide relevant regulators with a broader scope and more powers to enforce the relevant laws.
The collection of personal data is an integral part of the regular business operations of most organizations. These laws and amendments therefore will have a significant impact on how organizations are conducting their business in Greater China.
