In a decision that should put the nation’s private and independent school community on notice, U.S. District Judge Richard D. Bennett for the District of Maryland recently ruled that a school’s 501(c)(3) tax-exempt organization status, in and of itself, constitutes the receipt of federal financial assistance, making the school subject to Title IX requirements. A similar decision was reached by a California federal court just days later. These are significant developments in the education industry, including the potential for new compliance obligations for independent schools, and all private K-12 schools should be watching closely.
Please join our M&S Education Law team on August 23 for a webinar that will focus on these recent cases, including expected appeals, the impact for schools both inside and outside of Maryland and California, how the Department of Education’s recently proposed changes to the current Title IX regulations may impact policies, and what steps administrators and boards should be taking to better position their school to adapt to all of these changes.
