Dette speciale behandler retsstillingen for tidsbegrænset ansatte lønmodtagere ved en offentlig arbejdsgiver, som følge af den ikke-rettidige implementering af direktiv om tidsbegrænset ansættelse i dansk lovgivning.

Herudover behandles myndighedernes fortolkning af direktivet i relation til fornyelser og forlængelser af eksisterende ansættelsesforhold. Til behandlingen heraf benyttes overordnet to myndighedsopfattelser.

Det antages, at danske myndigheder er af den opfattelse, at tidsbegrænsede ansættelsesforhold ikke er beskyttet af direktivet før ikrafttrædelsen af lov om tidsbegrænset ansættelse. EU-retlige fortolkningsprincipper og EU-retspraksis taler imidlertid for, at beskyttelsen allerede foreligger fra direktivets implementeringsfrists udløb i national lovgivning.

Det ene hovedformål med specialet er at afklare, hvilken af disse retstilstande, der i et juridisk perspektiv er den korrekte, herunder om og på hvilket grundlag Danmark handler direktivstridigt.

Det andet hovedformål med specialet er at analysere om arbejdstagerne sikres den beskyttelse, som er direktivets hensigt. Til at belyse dette behandles den anden myndighedsopfattelse som er, at ansættelsesforhold forud for direktivet og lovens ikrafttræden ikke er relevante, og at der kan ske fornyelse af disse, uanset grænsen fastsat i retspraksis på maksimalt 2-3 fornyelser.

Det konkluderes, at den danske stat har været forpligtet til at fortolke direktivkonformt og imødekomme direktivets målsætning allerede fra den 10. juli 2002. I relation til den anden myndighedsopfattelse konkluderes det, at den er i strid med direktivets formål og rammeaftalen efter hvilken niveauet for beskyttelse af arbejdstagerne ikke må sænkes.

På baggrund af de to nævnte myndighedsopfattelser kan det sammenfattende konkluderes, at målsætningen med direktivet ikke nås, og at myndighederne har handlet direktivstridigt.
