The running theme of ascertainability is now stretching into antitrust in a recent decision involving the egg industry, demonstrating that this issue continues to be at the core of many class certification arguments. The banking industry is experiencing varying decisions on certification, and consumer protection cases continue to heat up on the same issue.
The topic of worker classification was again addressed in the last quarter with cases involving everything from Uber drivers in California to strippers in South Florida. Air quality and ground contamination were hot issues across several environmental cases, and the TCPA and hacking concerns dominate the privacy arena.
