Q: We need to implement a new time clock system this year and there are some easy to use ones that use fingerprints, retina scans, or hand scans. I know biometrics are a big issue - does Iowa limit the use of biometric data for employee purposes - such as time clock use?

A: Iowa does not have a specific biometric data statute, unlike our neighbor Illinois. Illinois has one of the more robust statutes in the country. However - and it’s a big however - this is data you need to keep secure under the general data security statutes. Breach of that data is likely to cause a need to notify employees and can lead to significant identity theft issues.
