OFCCP Publishes New Compliance Assistance Materials for Compliance Check Reviews

On May 8, 2019, the Office of Federal Contract Compliance Programs (OFCCP) went live with a new Compliance Checks webpage. Similar to the recent Section 503 focused reviews landing page, the Compliance Checks webpage offers federal contractors a variety of resources that will assist in preparing for and responding to a compliance check review. OFCCP’s new webpage links to:

OFCCP announced on March 25, 2019, that 500 contractor establishments would be scheduled for compliance check reviews. OFCCP will be conducting these reviews to make sure contractors are maintaining affirmative action programs (AAPs), properly advertising for job openings, and keeping records of accommodations requested and granted to individuals with disabilities.

The FAQs posted also address OFCCP’s intent to review the results of a contractor’s AAP — including the goals report for women and minorities, as well as outreach and recruitment for women, minorities, veterans, and individuals with disabilities. OFCCP’s compliance assistance further confirms that a contractor may choose to provide information responding to a compliance check scheduling letter either offsite or onsite. OFCCP will also be reviewing the System for Award Management website to check that contractors have self-certified compliance with their affirmative action obligations.

Contractors identified on the FY2019 CSAL list may want to review OFCCP’s new compliance materials and ensure the company is prepared to receive and respond to a compliance check as scheduling letters may begin arriving any day now.
