Today, May 10, OSHA announced that Agency head David Michaels will be conducting a morning press briefing on Tuesday, May 11 covering an undisclosed workplace safety topic, which likely means that OSHA is going to announce the release a final rule or announce a new initiative, and that would almost certainly be the new Recordkeeping Rule. The White House's Office of Information and Regulatory Affairs (OIRA) completed its analysis of the recordkeeping rule on April 29, so we have been waiting with baited breathe.
In addition to the proposed burdensome requirements to electronically submit establishment and companywide Injury data, the new Rule will probably create a new Retaliation claim for workers, as well as define Companies, the "Enterprise," in a way that will make it easier for OSHA to issue Repeat citations and attack an entire company, including subsidiaries, parents and affiliated companies.
