Description: In practice, policies and the laws created to enforce them, should be rooted in evidence. Research on the impacts of various policy decisions and the behavior or products subject to regulation should drive decision making. However, as we have seen in the cannabis industry, when the underlying research is biased and/or the behavior highly stigmatized and stereotyped, policies and laws may not reflect reality, and in some cases may directly contradict it.

Description: This panel will cover issues surrounding the balance that jurisdictions must strike between deploying enforcement as a means to support a regulated market and enacting legislation to support the transition of a legacy market. Presenters will discuss novel ways in which regulators are, or should be, incentivizing legacy and unlicensed operators to transition to the regulated market as opposed to relying heavily on criminal enforcement, which may lead to a War on Drugs 2.0.
