The Federal Trade Commission (FTC) announced on May 9, 2025 that it will delay full implementation of the amended Negative Option Rule and begin enforcing it on July 14, 2025.
The FTC finalized significant updates to the rule last October, which were originally scheduled to take effect on May 14, 2025. The delayed implementation date applies to 16 C.F.R. §§ 425.4–425.6 and is intended to give businesses more time to comply. The new rule requires, among other things, that cancelling automatically renewing subscriptions online be just as easy as it is to subscribe in the first place.
The FTC’s announcement confirms its support for the new rule despite the change in Administration and ongoing litigation challenging the rule.
