October Consumer Litigation Filings: Mixed Bag

According to a recent report by WebRecon, court filings under the Fair Credit Reporting Act (FCRA) and Telephone Consumer Protection Act (TCPA) were down for the month of October, but filings under the Fair Debt Collection Practices Act (FDCPA) were up. Complaints filed with the Consumer Financial Protection Bureau (CFPB) were also up for the month.

WebRecon reports the overall statistics for consumer litigation in October as follows:

  • 485 FCRA cases were filed, representing a 7.8% decrease from September;
  • 414 FDCPA cases were filed, representing a 14.7% increase from September;
  • 129 TCPA cases filed, representing a 17.3% decrease from September; and
  • 5,517 complaints filed with the CFPB, representing a 3.1% increase from September.

Year-to-date cases are still down for FDCPA and FCRA filings, but TCPA’s big jump in May made for a year-to-date gain of 11.5%. CFPB complaints are down 1.4% for the year.
