BAG: Gesetzlicher Urlaubsanspruch trotz ruhenden Arbeitsverhältnisses

Der Arbeitgeber muss einem Arbeitnehmer, der (unbezahlten) Sonderurlaub nimmt, den gesetzlichen Urlaub zum Ende des Beschäftigungsverhältnisses gegebenenfalls trotz ruhenden Arbeitsverhältnisses abgelten. Dies hat das BAG am 6. Mai 2014 (Az.: 9 AZR 678/12) entschieden.

Die Klägerin war bei der beklagten Universitätsklinik seit August 2002 als Krankenschwester beschäftigt. Für den Zeitraum vom 1. Januar 2011 bis zum 30 Juni 2011 wurde der Klägerin unbezahlter Sonderurlaub genehmigt. Dieser wurde einvernehmlich bis zum 30. September 2011, zugleich der Zeitpunkt, in dem das Arbeitsverhältnis endete, verlängert. Die Klägerin verlangte von der Beklagten die Abgeltung von 15 Urlaubstagen aus dem Jahr 2011.

Nachdem die Klägerin zunächst vor dem Arbeitsgericht Berlin in erster Instanz erfolglos bleib, schloss sich das BAG am 6. Mai 2014 der Rechtsauffassung des LAG Berlin-Brandenburg (vom 15. Mai 2012 – 3 Sa 230/12) an und bejahte den Anspruch der Klägerin.

Die Entstehung des gesetzlichen Urlaubsanspruchs nach § 1 BurlG erfordere lediglich den rechtlichen Bestand des Arbeitsverhältnisses und die einmalige Erfüllung der Wartezeit. Dem BAG zufolge sei der Urlaubsanspruch nicht an die Erfüllung der Hauptpflichten aus dem Arbeitsverhältnis geknüpft und dürfe bei Ruhen des Arbeitsverhältnisses nicht gekürzt werden. Eine Ausnahme gelte nur in gesetzlich geregelten Sonderfällen wie der Elternzeit (§ 17 Abs. 1 Satz 1 BEEG) oder dem früheren Wehrdienst (§ 4 Abs. 1 Satz 1 ArbPlSchG). Damit hatte die Revision der Beklagten vor dem 9. Senat des BAG keinen Erfolg. Der vereinbarte Sonderurlaub stünde dem Entstehen des gesetzlichen Urlaubsanspruchs zu Beginn des Kalenderjahres 2011 nicht entgegen. Zur Kürzung des gesetzlichen Urlaubs sei die Beklagte ebenfalls nicht berechtigt.
