EEO-1 Portal to Remain Open Through January 9th

The Equal Employment Opportunity Commission (EEOC) has updated their EEO Data Collections information page to provide guidance on how to proceed as an EEO-1 report filer past the original deadline of Tuesday, December 5, 2023.  All filers who have not submitted and certified their mandatory 2022 EEO-1 Component 1 Report(s) by the Tuesday, December 5, 2023 deadline have received or will receive a notice of failure to file. The notice will instruct them to submit and certify data as soon as possible, no later than Tuesday, January 9, 2024.

Reports submitted and certified after the original deadline but prior to the January 9th deadline will display that the filing was late. EEOC has indicated that “no additional EEO-1 Component 1 reports will be accepted” after January 9th and eligible employers that do not submit the required reports by that date “will be out of compliance with their mandatory 2022 EEO-1 Component 1 filing obligations.” 

The EEO Data Collections page mentions that if a request has been submitted to their Filer Support Team, filers should exercise patience and refrain from submitting additional inquiries to them as they are in the process of addressing each one logged in their system. 

The EEO-1 submission period was delayed earlier this year resulting in the portal opening much later than it has in previous years.  

Private employers with 100 or more employees or federal contractors with 50 or more employees that have not submitted and certified EEO-1 reports during the 2023 filing period should do so as quickly as possible.
