Last week, a California judge made news when he threw out a
$7.1million jury verdict. The verdict had been handed down in the high-profile age and disability discrimination suit brought by the well-known sports curmudgeon T.J. Simers. Simers alleged that he had been constructively discharged when the
Los Angeles Times demoted him from columnist to reporter. The judge overturned the jury’s decision and ordered a
new trial, ruling that Simers had not suffered an adverse employment action and had voluntarily resigned.
